Ensuring appropriate policies and processes

The fundamental piece of legislation is the Equality Act 2010

Discrimination is an area all employers need to be acutely aware of. This potentially can be a difficult and sensitive subject and it is essential to get it right by ensuring the appropriate policies and processes are in place.

It is against the law to discriminate against anyone because of:

  • Age
  • Disability
  • Gender reassignment
  • Marriage and civil partnership
  • Pregnancy and maternity
  • Race
  • Religion and belief
  • Sex
  • Sexual orientation

These are what are referred to as ‘protected characteristics’. You are also protected from discrimination if:

  • You are associated with someone who has a protected characteristic, e.g. a family member or friend.
  • You have complained about discrimination or supported someone else’s claim.

Under the Equality Act 2010 people are not allowed to discriminate, harass or victimise another person because they have any of the protected characteristics.
